§ 5.03. CITY CLERK.

  • (a)

    Appointment and Term. The City Clerk shall be appointed by the Council and shall hold office as provided in Section 5.19 of this code.

    (b)

    Deputies. The City Clerk, with the approval of the Council, shall have authority to appoint a Chief Deputy and such other deputies as the work of the office may require. The Deputy City Clerks shall have full power and authority to act in all matters the same as the City Clerk.

    (c)

    Council Records and Ordinances. The City Clerk or Deputy City Clerk shall attend all sessions of the Council, keep an accurate journal of their proceedings in a book or books provided for that purpose, and keep in a separate book a record of the titles and copies of all ordinances passed by the Council. He shall see that each ordinance is published as directed by the Council, and in the manner required by the laws of Iowa. He shall keep a book or books to be known as proof of publication record and shall file therein sworn statements of publication of all ordinances, resolutions or notices required by the laws of Iowa or orders of the Council to be published in the newspapers. He shall keep a record of the appointments of officers of the city, and whenever a commission is issued by the Mayor to any such officer the City Clerk shall affix the city seal thereto and countersign the same.

    (d)

    Copies of Records. The City Clerk shall furnish to any city officer a copy of any record, paper or public document made or filed in his office, when the same may be necessary to said officer in the discharge of his official duties. He shall also furnish a like copy to any person when requested, but in the latter case the city shall be entitled to a reasonable reimbursement of costs of the copy, to be prepaid.

    (e)

    Custodian of Records; Seal. The City Clerk shall, under the direction of the Council, affix the common seal of the City of Cedar Rapids to all public instruments, or other official acts which, by law or ordinance are required to be attested by the city seal. He shall preserve the seal in some secure place, beyond the handling of the public. He shall have the custody of and keep safely all public records, documents, ordinances, resolutions and orders of the Council, and such other papers and documents pertaining to the city affairs as may be delivered into his custody. He shall file all plats and schedules relating to public improvements required by law and give prompt notice of all such plats by publication or otherwise when required so to do by law or by order of the Council.

    (f)

    Other Duties. The City Clerk shall perform such other duties as are imposed upon him by the Code of Iowa, by this code, or by order of the Council.
