§ 61.095A. RESIDENTIAL SNOW EMERGENCY ALTERNATE SIDE PARKING.

  • (a)

    Upon declaration of a residential snow emergency by the City Manager or his/her designee, vehicles which are parked on public streets not designated and signed as "Emergency Snow Routes" shall comply with the following.

    1.

    From 8:00 a.m. to 4:00 p.m. on the next day following a declaration of a residential snow emergency, vehicle parking on public residential streets shall only be permitted on the side of the street with even numbered addresses on even numbered calendar days or odd numbered addresses on odd numbered calendar days.

    2.

    From 8:00 a.m. to 4:00 p.m. on the second morning following such declaration of a residential snow emergency, parking will be permitted only on the opposite side of the street as was permitted the previous day.

    3.

    Permitted parking on these 2 days following the declaration of residential snow emergency on public residential streets shall not apply to posted emergency snow routes, Interstate 380, parking metered areas in the central business district or other areas where parking is presently restricted between the hours of 2:00 a.m. and 6:30 a.m., and any street where the alternate side parking would conflict with permanently posted parking restrictions.

    (b)

    Any officer of the City of Cedar Rapids Police Department or authorized representative of the Department of Streets and Public Improvements shall be authorized to cause the towing or other removal of vehicles parked in violation of this section.

    1.

    Removal of vehicles as authorized by this subsection shall be accomplished as provided in Section 61.103 Municipal Code, City of Cedar Rapids.

    2.

    In the event that ownership of a vehicle removed pursuant to this subsection cannot be ascertained, the provisions of Section 61.103 of this chapter regarding abandoned and inoperative vehicles shall be complied with.

    3.

    The owner of the vehicle or the person otherwise entitled to possession thereof shall pay the reasonable costs of towing and storage occasioned by removal of the vehicle removed herein provided.

    (c)

    On each street designated as a snow route by the City Council, signs with the words "Emergency Snow Route" shall be posted.

    (d)

    In any prosecution for violation of this section, proof that the vehicle described in the complaint was parked or allowed to remain on a residential public street in violation of this section, together with proof that the defendant named in the complaint was, on the date and time entered on the complaint, the registered owner of the vehicle is presumptive evidence that the defendant was the person who violated this section.

    (e)

    Each consecutive hour during one calendar day that a vehicle is parked or allowed to remain on a declared residential snow emergency alternate side parking on public streets in violation of this section shall be a separate and distinct offense under this chapter. The first offense shall terminate one hour after the time a ticket charging such offense is issued, which time shall be noted on the ticket, and a separate and new offense shall occur during each one-hour period thereafter.

    (f)

    The procedures and penalties applicable to parking violations and set forth in Section 61.110 of this chapter shall apply to violations of this section.
